I. In compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP), its Regulations, and the Guidelines issued by the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI), Costa Realty makes this Comprehensive Privacy Notice available to its clients, suppliers, employees, partners, and the general public.
The legal entities responsible for collecting your personal data will be the controlling, subsidiary or affiliated companies that are under the common corporate group of “Costa Development”, S.A. de C.V., a variable capital corporation, legally incorporated and registered in the United Mexican States, operating under the name: “Costa Realty”, indicating as its registered office for all legal purposes the one located at:
Avenida Bonampak, corner Donceles, Manzana 3, Lote 11, Local C-109 Int. A, Condominio Palmeras, Cancún, Benito Juárez, Quintana Roo, C.P. 77500.
Hereby, we inform you that the personal, patrimonial or financial data that you have provided to this company by any means, through emails, telefax, form filling, telephone calls, contracts, mail, business cards, digital media, etc.; will be treated strictly under the principles of legality, consent, information, quality, purpose, loyalty and responsibility.
II. DATA COLLECTED.
“Costa Realty” collects the following personal data in an illustrative but not exhaustive manner
1. Identification: Name, address, nationality, place and date of birth, age, marital status, RFC, CURP, handwritten signature, official identification number, and immigration documents.
2. Contact: Phone numbers, personal or institutional email addresses.
3. Work and professional: Occupation, Profession, position or title, business activity or line of work.
4. Financial assets: Income, expenses, bank accounts, account statements, credit history, real estate, public deeds, utility receipts, tax receipts, guarantor or surety information, data for credit processing.
5. Operating data: Contracts, purchase-sale agreements, leases, contract validity, and rental amounts.
6. Personal or professional references.
Costa Realty does not request sensitive data, except for what is strictly necessary to comply with applicable contractual or legal obligations.
III. PURPOSES OF PERSONAL DATA PROCESSING.
“Costa Realty” hereby informs you that the personal data you provide will be used for:
A. Primary purposes (necessary):
1. To formalize and carry out real estate brokerage operations (purchase and sale, leasing, management or marketing of real property).
2. Draft and formalize contracts, purchase agreements, and leases.
3. Verify and confirm the identity, tax status, and financial solvency of the holder.
4. Carry out procedures with notaries, financial institutions, INFONAVIT, FOVISSSTE, tax authorities, and other municipal, state, or federal agencies.
5. Evaluate the quality of the services and fulfill the obligations arising from the legal relationship.
B. Secondary purposes: (optional):
1. Sending information about services, promotions, or properties that may interest you.
2. Development of studies and satisfaction surveys.
3. Follow-up contact for future real estate operations or projects.
4. Personalized access to our web portal and digital platforms.

If you do not wish your data to be processed for secondary purposes, you may state so by sending your request to: ecommerce@costarealty.com.mx.
If you do not hire our real-estate services, we also suggest keeping your information in our updated database so we can contact you and give you priority with our products and services.
Your personal data will be kept under the strictest confidentiality and will not be used for any purpose other than those mentioned above, unless a change is made to this Privacy Notice.
IV. ARCO RIGHTS.
Article 28 of the LFPDPPP grants you four rights to exercise:
· Access your personal data held by the data controller, to be informed of the Privacy Notice and its purposes.
· Update your information if it is inaccurate, incorrect, or out of date.
· Cancel your personal data when you consider that they are not being used for the purposes established in this Privacy Notice.
·To object to the processing of your personal data regarding any of the purposes established in this Privacy Notice.
“Costa Realty” shall not be obligated to delete personal data when it falls under any of the cases established by law, including, among others: when it pertains to the parties of a private, social, or administrative contract and is necessary for its development and fulfillment; when it must be processed by legal provision or order of a competent authority; when its deletion would obstruct judicial or administrative actions related to tax obligations, prosecution of crimes, or the updating of administrative penalties; when it is necessary to protect the legally protected interests of the data subject; when it is necessary to fulfill a legal obligation undertaken by the data subject; and when it is subject to processing in accordance with the Federal Law for the Prevention and Identification of Operations with Resources of Illicit Origin (LFPIORPI) and other applicable regulations on the prevention of money laundering and terrorism financing.
In these cases, personal data will be kept only for the time required to fulfill the corresponding legal obligations, applying the necessary administrative, technical, and physical security measures for its protection.
V. OPTIONS AND MEANS TO LIMIT THE USE OR DISCLOSURE OF DATA.
We also inform you that the personal data provided to “Costa Realty” are duly protected through technological, physical, and administrative security measures, preventing their misuse or improper disclosure.
To limit the use or disclosure of your personal information, the owner may:
VI. MECHANISMS FOR THE EXERCISE OF ARCO RIGHTS AND REVOCATION OF CONSENT FOR THE PROCESSING OF YOUR DATA.
To exercise your rights of Access, Rectification, Cancellation, and Opposition or your right to revoke consent for the processing of your personal data, you must submit a free-form written request stating what you deem appropriate regarding misuse or correction of your personal data, sent to the following email address: mgodoy@costarealty.com.mx, with a copy of your official ID and complying with the requirements set forth in Article 29 of the Regulations of the LFPDPPP. Alternatively, you may submit your written request in person, in Spanish, in accordance with the requirements established in the aforementioned article at the address specified in section (I) of this Privacy Notice. The response will be issued within a maximum period of 5 business days, indicating whether the request is admissible or inadmissible in accordance with the provisions of the LFPDPPP.
VII. DATA TRANSFER
The personal data that has been provided to us will never be disclosed or shared with third parties, in the sense that, for purposes of this Privacy Notice, the following cases will not be considered as third parties:
Likewise, the data may be shared solely in order to carry out, in collaboration, the necessary procedures for commercial real-estate brokerage activities related to the purchase, sale, leasing or management of real property.
Any third parties to whom personal data is transferred shall be bound by the same terms of this Privacy Notice and shall comply with the respective security and confidentiality measures.
Likewise, we are required to transfer your personal data to third parties without your consent, under the principles of lawfulness, consent, information, purpose, loyalty, proportionality, and accountability, solely for the cases established in Article 37 of the LFPDPPP, as well as to carry out such transfer under the terms of the aforementioned Law.
VIII. REVOCATION.
The holder of personal data may revoke their consent for the processing of personal data at any time, in accordance with Article 8 of the LFPDPPP, and must, solely for such purposes, submit their request through a free-form letter to the Personal Data Manager: Mrs. Margarita Godoy Ávila, either by courier to the address or to the email mentioned in section (VI) of this Privacy Notice.
Likewise, the holder of the personal data is informed that “Costa Realty” will have a period of 7 calendar days to respond to your request, and the response will indicate whether the request is admissible.
IX. COOKIES
“Costa Realty” uses its own and third-party cookies to analyze your browsing and offer you a more personalized service tailored to your interests. Certain areas of our site also use cookies to learn more about you in order to provide you with a personalized browsing experience. X. HOLDER’S CONSENT.
Under the terms set forth in Article 8 of the LFPDPPP, the data subject shall be deemed to have given tacit consent to the processing of their personal data when, having been provided with this Privacy Notice, they do not expressly state their opposition.
XI. CHANGES TO THE PRIVACY NOTICE.
We reserve the right to modify or update this Privacy Notice at any time, whether due to regulatory changes, internal needs, or new data-protection practices. Updates will be available through any of the following channels:
1. Visible advertisements in our establishments.
2. On our website.
3. We’ll send them to the last email address you provided us.
We will not be responsible if you do not receive the notification of changes to the Privacy Notice due to any problem with your email account or data transmission over the internet.
